For leave years starting after 1st April 2009 full time workers are entitled to a minimum of 28 days PAID holiday.
If you work part time then you are still entitled to paid holiday relative to the number of days you work. For example, if you work three days per week you will be entitled to 16 days (approx).
See the government website and the business link website for useful calculators to work out your entitlement
Also, check your employment contract as you may be entitled to additional leave.
You should be paid at the same rate as when you are actually physically working. Some employers state that your hourly rate includes holiday pay (sometimes referred to as “rolled up” holiday pay) to cover you in holidays. However, this may be against the law, unless they identify the amount that you are paid for holiday in addition to your normal pay, for example on your payslip.
The issues involved in rolled up holiday pay can be complicated, due to recent case law, please contact us for further advice. Please note that any claims for holiday may need to be made within 3 months of when you should have been paid and you can probably only get it for your current leave year, so don’t delay getting advice!
