► Full-time students

In general, if you are a full-time student you will not be eligible to claim benefits such as Income Support or Housing Benefit/Local Housing Allowance for the duration of your course unless you have a disability, are incapable of work due to sickness, look after someone with a disability or have dependents. This generally also includes students during intermission, although students who are intermitting should speak to one of our Advisers for further information. Being a full-time student will not affect your eligibility for tax credits however.

If you are in receipt of benefits before starting your course, you MUST inform the relevant office when you become a student. Whilst some benefits are not affected by your study, you could find that you are not entitled to others or that your entitlement is reduced. Failure to inform the relevant office could lead to an overpayment being made which may be recoverable, or even a benefits fraud investigation.

As a full-time student you may be eligible to claim Income Support, Housing Benefit/Local Housing Allowance and Council Tax Benefit in the following circumstances:

 

 

  • You are a single parent or foster parent*
  • You or your partner are aged over 60
  • You are a disabled student or have been sick for 28 or more weeks and can satisfy certain qualifying conditions**
  • You receive a Disabled Students Allowance for deafness**
  • You are a refugee who is attending a course for the purposes of learning English
  • You have a partner who is not a student (in which case it is the partner who must make the claim)
  • You are a student couple with dependants (in which case you may be able to claim Housing Benefit/Local Housing Allowance throughout the year and Job Seekers Allowance during the summer vacations only).

However, because the rules surrounding entitlement to benefit whilst studying are different for each benefit, you should speak to one of our Advisers.

* From October 2008 new Welfare Reform laws took effect that mean you are only eligible to claim Income Support on the grounds that you are a single parent if you have a child aged under 12.  This changed again in October 2009 to a child aged under 10, and will change again in October 2010 to a child aged under 7.

** From 27 October 2008 Employment and Support Allowance (ESA) replaced Incapacity Benefit and Income Support claimed on the grounds of incapacity for work.  Under the new rules, most students who are disabled and/or incapable of work are only eligible to claim ESA if they have paid sufficient National Insurance contributions; OR satisfy certain qualifying conditions relating to 'incapacity in youth'; OR are in receipt of Disability Living Allwance.
