The University of Sussex Students’ Union is currently an exempt charity. Following recent legislation the students’ union will have to become a registered charity. This may involve the union becoming a company limited by guarantee (CLG). There is a substantial body of legislation and case law concerned with our activities and with the conduct of our sabbatical officers who are the Students’ Union’s Trustees.
Currently the positions of President, Finance Officer and Communications Officer also act as Company Directors for the Union’s trading company. If the Union becomes a company limited by guarantee, then all sabbatical officers will become Company Directors.
Below is a list of circumstances that may prevent you from becoming a trustee or company director. If you want to ask for clarification on any of these points, please come and speak to Paul Newton, Union Director (senior member of staff) or e-mail him at p.d.newton@sussex.ac.uk
If you are in any doubt about your eligibility to act as a Trustee you should either seek your own legal advice or contact the Charity Commission.
When you apply as a candidate for Sabbatical office, you will be required to sign that you have read and understood the above criteria, and confirm that you are eligible to exercise the rights, duties and responsibilities of a Trustee of the Union and those of a Company Director.
